Rahul Gandhi has been convicted and sentenced him to 2 years in jail in a criminal defamation case over his remark during the 2019 Lok Sabha election. Rahul Gandhi at a rally in Karnataka's Kolar wondered how come "all thieves have Modi as the common surname". Rahul Gandhi was present at the court when the verdict was announced. The Wayanad MP also got bail after the court pronounced the order after paying a bail bond of ₹10,000, The case against Rahul Gandhi was filed under Indian Penal Code Sections 499 and 500. Under Sections 499 and 500, a punishment with simple imprisonment for a term which may extend to two years, or with fine, or with both, are mentioned in the I.P.C.

Regards this type matter, Any elected representative who is sentenced for any offence for a period of two years or more faces immediate disqualification under the Representation of Peoples Act, 1951. One provision of the Act that
granted three months’ protection from disqualification was struck down in 2013 The Supreme Court had given a Judgement that from the court gives verdict of 2 years or more then 2 years then from the same point of time any member of loksabha, Rajyasabha or Vidhansabya his members get cancelled. Till final Judgement if the dismissed member has
appealed.
Now the loksabha Secretariat will have to inform to Loksabha Speaker and Chief Election commissioner of India about the court Verdict. This a matter of 5 days to process after official verdict order copy is served to loksabha
Secretariat for further action.

And DELHI HIGH COURT asks Centre, RBI to respond probe into Yes Bank's assets transfer.
The plea states that this transfer is connected to another transaction in which Yes Bank has acquired up to 19.9% stake in JC Flowers. The plea states that the petitioner is “worried, based on media reports, disclosures by Respondents No. 5 (JC Flowers), and certain legal provisions, that these transactions lack impartiality, attempt to bypass relevant laws, and are not in the best interest of the general public” who have accounts with Yes Bank “As per the information available in the public domain, the transactions involving the transfer of the distressed asset portfolio from Yes Bank to JC Flowers lack fairness, attempts to evade relevant laws, and do not serve the best interests of the general public who have accounts with Yes Bank,” the plea states.
The plea has been filed in the context of the transfer of a distressed asset portfolio worth Rs 48,000 crore from Yes Bank to JC Flowers last year.
The public interest litigation plea seeks a direction to the Centre, SEBI and RBI to formulate proper and comprehensive guidelines in accordance with the recommendations of the committee to check any such future transactions and to regulate the arrangements entered into between banks or other financial institutions and asset reconstruction companies.
“As per the information available in the public domain, the transactions involving the transfer of the distressed asset portfolio from Yes Bank to JC Flowers lack fairness, attempts to evade relevant laws, and do not serve the best interests of the general public who have accounts with Yes Bank,” the plea states.

Gautama Buddha's royal name was Siddhartha. He was the son of Suddhodhana, the Chief of Sakya clan of Kapilvastu in the Nepal Tarai area. He was born in 566 B.C. in the village of Lumbini a few miles from Kapilvastu. Siddhartha lost his mother at the time of his birth and was brought up by his aunt and step-mother.
His life story is divided into five stages: birth, insight, enlightenment, the first discourse and finally death.
He is one of the most important Asian thinkers and spiritual masters of all time, and he contributed to many areas of philosophy, including epistemology, metaphysics and ethics. The Buddha's teaching formed the foundation for Buddhist philosophy, initially developed in South Asia, then later in the rest of Asia.
The Eight Great Events are: the Birth of the Buddha, the Enlightenment, the First Sermon, the Parileyyakka Retreat (honey rice offering), the Taming of Nalagiri elephant, the Descent from Tavatimsa Heaven, the Miracle at Sravasti and the Parinirvana.

भोपाल गैस त्रासदी : सुप्रीम कोर्ट ने यूसीसी से अतिरिक्त मुआवजे की मांग की केंद्र की क्यूरेटिव याचिका खारिज की
सुप्रीम कोर्ट की एक संविधान पीठ ने मंगलवार को भोपाल गैस त्रासदी के पीड़ितों के लिए अतिरिक्त मुआवजे का दावा करने के लिए यूनियन कार्बाइड कॉरपोरेशन (अब डॉऊ केमिकल्स) के साथ समझौता फिर से शुरू करने की मांग वाली केंद्र द्वारा दायर क्यूरेटिव याचिका को खारिज कर दिया।
अदालने नोट किया कि समझौते को केवल धोखाधड़ी के आधार पर रद्द किया जा सकता है, लेकिन भारत संघ द्वारा धोखाधड़ी का कोई आधार नहीं दिया गया है। हालांकि, न्यायालय ने निर्देश दिया कि आरबीआई के पास पड़ी 50 करोड़ रुपये की राशि का केंद्र सरकार द्वारा लंबित दावों को पूरा करने के लिए उपयोग किया जाना चाहिए, यदि कोई हो।
जस्टिस एस के कौल, जस्टिस संजीव खन्ना, जस्टिस ए एस ओक, जस्टिस विक्रम नाथ और जस्टिस जे के माहेश्वरी ने 12 जनवरी 2023 को फैसला सुरक्षित रख लिया था।
न्यायालय ने नोट किया कि केंद्र सरकार सुप्रीम कोर्ट के निर्देश के अनुसार स्वयं बीमा पॉलिसी लेने में विफल रही -
"मुआवजे में कमी को पूरा करने की जिम्मेदारी भारत संघ की थी। बीमा पॉलिसी लेने में विफलता संघ की ओर से घोर लापरवाही है और इस न्यायालय के फैसले का उल्लंघन है। संघ इस पहलू पर लापरवाही नहीं कर सकता और यूसीसी पर जिम्मेदारी तय करने के लिए इस अदालत से प्रार्थना नहीं कर सकता।"

इसमें जोड़ा गया,

"हम दो दशकों के बाद इस मुद्दे को उठाने के लिए कोई तर्क प्रस्तुत नहीं करने के लिए भारत संघ से असंतुष्ट हैं।" न्यायालय ने कहा कि टॉप अप मुआवजे के लिए संघ की याचिका का कानूनी सिद्धांत में कोई आधार नहीं है। पीठ ने कहा, "या तो एक समझौता वैध है, या इसे धोखाधड़ी के आधार पर समाप्त किया जाना है। भारत संघ द्वारा इस तरह की किसी भी धोखाधड़ी की वकालत नहीं की गई है।"

कोर्ट ने कहा कि संघ का स्टैंड यह है कि कमिश्नर ने कानून के मुताबिक सभी दावों का फैसला किया है। इसके अलावा, 2004 में समाप्त हुई कार्यवाही में यह स्वीकार किया गया कि राशि वास्तविक आवश्यकताओं को पूरा करने के लिए पर्याप्त है। इस प्रकार दावेदारों को उचित मुआवजे से अधिक का भुगतान किया गया। यह इस स्थिति को पुष्ट करता है कि समझौता राशि पर्याप्त थी।
पीठ ने यह भी कहा कि यूसीसी का मामला यह था कि राज्य और संघ साइट को डिटॉक्स करने में विफल रहे जिससे समस्याएं बढ़ गईं। किसी भी मामले में, यह वृद्धि की मांग करने का आधार नहीं हो सकता है।

तीन दिनों की अवधि में, पीठ ने केंद्र सरकार की ओर से भारत के अटार्नी जनरल आर वेंकटरमनी ; संगठनों और आपदा के पीड़ितों का प्रतिनिधित्व कर रहे एडवोकेट करुणा नंदी और सीनियर एडवोकेट, संजय पारिख की दलीलों को सुना। उनकी दलीलों का सीनियर एडवोकेट हरीश साल्वे ने विरोध किया, जो डॉऊ केमिकल्स के लिए पेश हुए।
बिल्कुल शुरूआत में , पीठ ने क्यूरेटिव याचिकाओं के दायरे के बारे में सवाल उठाए थे और चिंता व्यक्त की थी कि ऐसा प्रतीत होता है कि केंद्र सरकार 1989 में बहुत पहले हुए समझौते को फिर से खोलने या जोड़ने की मांग कर रही है। अटॉर्नी जनरल ने मुआवजे की राशि की अपर्याप्तता और बाद के घटनाक्रमों के आलोक में इसे संशोधित करने की आवश्यकता का संकेत देकर सरकार के रुख का बचाव किया। जज इस बात से चकित थे कि केंद्र सरकार को यह महसूस करने में 25 साल लग गए कि 1989 में निर्धारित मुआवजा अपर्याप्त था। जस्टिस कौल ने कहा कि 1989 में जब समझौता हुआ था तो यह कॉरपोरेशन और भारत सरकार के बीच था न कि असमानों के बीच, इसलिए उत्पीड़न की कोई गुंजाइश नहीं हो सकती थी। सुनवाई के दौरान विभिन्न बिंदुओं पर न्यायाधीशों द्वारा इस बात पर जोर दिया गया कि मुआवजे का एक हिस्सा, जो कि 50 करोड़ 25 लाख रुपये है, अभी भी भारतीय रिजर्व बैंक के पास पड़ा हुआ है।

साल्वे ने पीठ को अवगत कराया कि क्यूरेटिव याचिका में केंद्र सरकार की दलीलें मूल मुकदमे में उठाए गए मुद्दे के दायरे से बाहर चली गई हैं। उन्होंने स्पष्ट रूप से बताया कि राहत और पुनर्वास और जहरीले कचरे के निपटान का मुद्दा वाद का हिस्सा नहीं था। हालांकि, अटॉर्नी ने आपदा की अभूतपूर्व प्रकृति को देखते हुए न्यायपीठ से जोरदार मुआवजा देने The court said the issue could not be "raked up three decades after the settlement". constitution.
But unlike the far-right flags that were seen during the insurrection
at Capitol Hill, The Sikh community considers the Nishan Sahib, also
known as the khalsa flag, sacred to its belief.The fear that the
religious flag could instead be a separatist one led commentators and
political leaders to believe that this act of defiance was a danger to
democracy.on Jan. 26, when the Nishan Sahib went up at the Red Fort
during protests that took a violent turn, the Khalistani tag was back.

They entered the iconic Red Fort and hoisted flags from some domes and
from a flagstaff, on the ramparts of the fort, used to unfurl the
tricolour on Independence Day. But claimed that the tricolour was

seeks to establish a Sikh homeland within the Punjab region. The
proposed state would consist of land that currently forms Punjab,
India and Punjab, Pakistan. The Khalistan issue came to a head in
1983 when a religious militant leader Jarnail Singh Bhindranwale
seized the Golden Temple with his armed followers. This prompted Prime
Minister Indira Gandhi to launch ‘Operation Blue Star’ that resulted
in the deaths of Bhindranwale and his followers and massive damage to
the Golden Temple. In the aftermath, PM Indira Gandhi was assassinated
by her own Sikh bodyguards. In the 1990s, the insurgency petered out
and the movement failed to reach its objective for multiple reasons
including a heavy police crackdown on separatists, factional
infighting, and disillusionment from the Sikh population..

The 3,000-tonne diesel-electric submarine, INS Sindhukesari, reached Jakarta for the ‘maiden operational turnaround’ after transiting through the Sunda Strait on Wednesday. “Indian warships often visit Indonesia and other Asean countries. This first long-range deployment of a submarine underlines the operational capability and reach of the country’s underwater combat arm as well,” a senior official told.
Chinese submarines use the Malacca, Lombok, or Sunda Straits to reach the Indian Ocean. The Sunda Straits are very shallow, with a mean depth of 50 meters. Sandbanks, the presence of oil platforms in the Sunda shelf, and the active presence of fishing vessels render it difficult to navigate in these waters. The Lombok Strait is deep enough for submarines to proceed in the normal mode of navigation. In the case of the Malacca Strait, to ensure navigation safety Chinese submarines have to navigate on the surface. The submarines are often accompanied by submarine-tender ships, a giveaway for the presence of the Chinese submarine.
India needs to strengthen its underwater domain capability and requires a fresh rethink on the concept of undersea warfare to deal with the emerging underwater threat from China in the Indian Ocean.
India has been working on bolstering its maritime capability with a focus on the Indian Ocean in the backdrop of concerns over China's growing forays into the region, considered the backyard.
The Project-75 includes indigenous construction of six submarines of Scorpene designs.

Gold deposits can be found at the Keonjhar district's Dimirimunda, Kushakala, Gotipur, and Gopur; the Mayurbhanj district's Joshipur, Suriaguda, Ruansila, and Dhushura Hill; and the Deogarh district's Adas region. If the company fails, the issuer will issue a B- credit rating and the already deep-in-the-junk- bond category would come under pressure. He said company Vedanta Ltd share price has been nose-diving since the past four sessions. It fell 8.84% on Tuesday to reach an intraday low of ₹ 261.95 apiece. The company’s shares were trading at ₹ 268.20 apiece, down 6.66% at 03:12 PM.

Market experts say that there is selling pressure on Vedanta’s share due to a roadblock in its acquisition of state-owned Hindustan Zinc and a sharp rise in the US dollar that led to the depreciation of Vedanta bond yield to ‘junk’ levels. They said that the company is facing a repayment crisis due to a fall in Vedanta’s bond yield in global markets. The government, which still holds about 30% stake in Hindustan Zinc opposed the transaction. “We would urge the company to explore other cashless methods for acquisition of these assets,” the Indian government said. In addition, it threatened the company that it would explore legal avenues if Hindustan Zinc still decided to go ahead with the purchase. Due to steep rise in US dollar rate in forex market, Vedanta bond yield has gone down,” said Anuj Gupta, Vice President — Research at IIFL Securities.

He added that as of 31st December 2022, around 99.99 percent of the promoters’ share in Vedanta had been pledged and hence is a big challenge for the company to generate additional money to meet its financial requirement arising in near future.

Anil Agarwal had started buying Hindustan Zinc from the Government two days ago on a privatization deal. The company has a cash pile of & 2 billion and it garners between $ 300 million and $ 600 million EBITDA per quarter. Vedanta Ltd currently owns 65% of the firm, decided in January to offload THL Zinc Ltd. Mauritius to Hindustan Zinc. The debt-laded Vedanta Resources owns Vedanta, and it would have taken care of the former’s liquidity needs.

Northern Army Commander Lt General Upendra Dwivedi on Tuesday said the Indian Army is ready to execute orders like taking back Pakistan-occupied Kashmir.
As far as the Indian Army is concerned, it will carry out any order given by the Government of India. Whenever such orders are given, we will always be ready for it," said Lt Gen Upendra Dwivedi, Northern Army Commander, on the Defence Minister's statement of taking back PoK.
The military is always ready to make sure that ceasefire understanding is never broken as it is in the interest of both nations, but if broken at any time, we will give them a befitting reply," said Dwivedi, Northern Army Commander on the ceasefire agreement between India and Pakistan.
"The country has over 50 per cent of people below the age of 25. If we take them in as Agniveers, teach them and send them back, we will absorb some, others by paramilitary, and police forces and the remaining can be self-employed," he stated.
We have almost 160 terrorists sitting at the launchpad of which there are 130 north of Pir Panjal and 30 south of Pir Panjal. As for the complete hinterland, a total of 82 Pakistani terrorists and 53 local terrorists are there," he further stated.
Earlier on October 28, Defence Minister Rajnath Singh reiterated New Delhi's resolve to take back PoK, saying all refugees would get their land and homes back.

The Russian invasion of Ukraine in
February 2022 posed challenges for Indian medical students who flew Ukarine for their medical journey. About 16,000 medical students were stranded in war-torn Ukraine. Following this, the Government of India (Gol) initiated the 'Operation Ganga' programme to evacuate all Indian medical students and bring them home safely. Post the return of these students their medical careers have been in jeopardy as the sudden
shift to India has left thousands of these medical students in a state of confusion. The students have raised several concerns regarding the validity of degree certificates, online classes, university exams, and internship opportunities. To communicate these difficulties, the students filed Public Interest Litigation (PIL) in the Supreme Court seeking directions on the issue of admission and continuation of studies in the country. The petition also sought an appropriate direction upon the respondents to provide adequate. infrastructure/ academic and financial support for the continuation of medical education of the evacuated Indian students from Ukraine. Experts' views on the situation Accommodation of Ukraine-returned medical students in Indian medical colleges is still controversial. Speaking to ETHealthworld Dr Rohan Krishnan, President, Federation of All India Medical Association (FAIMA) said, "Accommodation of Ukraine returned medical students in Indian colleges is next to impossible because in our country the examination system is very strict and we cannot allow anyone to join in between courses, because the curriculum of Ukraine and the curriculum of India is entirely different, also a lot of aspirants who are having a higher rank than those who have opted for Ukraine did not join the colleges because they wanted to join in India itself. So it will be unfair for those students who have a superior rank and did not take admission in foreign countries." Supporting Dr Krishnan's statement, Dr JA Jayalal, Immediate Past National President, Indian Medical Association (IMA) said, "The system of Indian medical education already has 95,000 graduates, accommodating these students in Indian colleges will set a very badmprecedent, and it will cause a lot of difficulty to the Indian medical education system. Thegovernment has decided that these students can only continue from a similar system of medical education in other countries. A lot of universities have come forward, including Russian universities to support the students. Some of the students have migrated, and those who have a problem with finance are not able to transfer." Although the academic mobility programme issued by the NMC provides opportunities, it also raises a challenge in terms of affordability. Commenting on the academic mobility programme Dr Krishnan said, "It is a welcoming move that these students have been allowed to take in the academic programme and continue their studies. But again, the affordability of medical education Speaking about the acceptance of online classes for Ukraine returned medical students Dr Jayalal said, "NMC policy is that online education mode cannot be accepted, and this decision is taken after a widespread discussion among the doctors and various administrative bodies which consider it mandatory." Adding to this Dr Krishnan stated, "Medicine requires bedside teaching. It requires a lot of patient-student interaction. So I welcome the move of NMC regarding the physical system because healthcare set-up, healthcare infrastructure, and healthcare facilities deal with people's life. It cannot be compromised at any level and the quality of doctors is of the utmost importance." As NMC does not consider online classes as a valid option, Dr Jayalal advised, "Those who have completed the four-and-a-half-year course and are in their final year were permitted to appear for the FMG examination, but we have asked them to do two years of internship, that is an order which is passed by the NMC. But the problem comes with the people who are in the first year and second year and continuing their course through online education, my only advice to these students is they should take it as a challenge. They should reappear for the Neet UG examination and get into the Indian medical education system. The accommodation of Ukraine-returned medical students in Indian medical colleges, and acceptance of online education has become controversial in the country. However, to resolve all these issues NMC has initiated an academic mobility programme, but five months since the mobility programme launched students have voiced certain difficulties regarding the programme and are struggling with their medical careers. This highlights the need for immediate government intervention and provide a resolution for a better future for these stranded medical students.
