ANTICIPATORY BAIL APPLICATION OF SO-CALLED JOURNALIST GURDEEP SINGH TALWAR @ MUNA DISMISSED

In the Court of Ld. Shri Rajeev Kumar Beri, Additional District & Sessions Judge, Jalandhar, an anticipatory bail application was filed by Gurdeep Singh, son of Ranjeet Singh, resident of House No. 317, Shaheed Bhagat Singh Nagar, Jalandhar, seeking protection from arrest.
After hearing the counsel for the State, the complainant, and the defence, the Hon’ble Court was pleased to dismiss the anticipatory bail application. The said application was filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) read with Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (BNS).
Background of the Case:
It is noteworthy that a written complaint was submitted by Ramesh Kapil to the Commissioner of Police, Jalandhar. The complaint stated that Gurdeep Singh Talwar uploaded an objectionable video on his social media channel, Yuva Savera. The contents of the video are against public interest and attract multiple penal provisions under the BNS, warranting registration of a case against Gurdeep Singh.
Criminal Antecedents:
It is pertinent to mention that the accused, who claims to be a journalist, Gurdeep Singh Talwar @ Muna, has a criminal record. Multiple cases are already pending adjudication against him in various courts relating to extortion, blackmail, intimidation for monetary gain, and using caste-based derogatory remarks.
Relevant Judicial Observations:
Recently, the Hon’ble Chief Justice of India, Supreme Court, made an observation referring to a “cockroach” analogy, which squarely applies to persons like Gurdeep Singh Talwar who, under the garb of journalism and social media, upload objectionable videos. Such individuals, driven by arrogance, disregard dignity and deliberately use casteist slurs to demean others. It is a settled position of law that using caste-based abusive language with intent to insult constitutes a punishable offence under the BNS.
